Despite the council’s knowledge of ongoing damp problems, it did not take necessary measures. This negligence resulted in Miss Y and her children experiencing serious health issues, including chest infections and asthma.

Systemic failures in tenant support

Miss Y’s situation highlights significant shortcomings in the council’s handling of tenant complaints. Although council officers visited to address various issues, they failed to tackle the persistent damp problem, which could have been identified much sooner. The Ombudsman noted that the council’s inaction during the cold months intensified the family’s hardship.

This neglect forced Miss Y to dispose of damaged belongings, including furniture and clothing, underscoring the emotional and financial burden on her family. In response to the Ombudsman’s recommendations, Flintshire Council admitted its failures and offered Miss Y financial compensation, in addition to a previous settlement.
