A man from Aberdeen has been ordered to stay away from his former partner after making alarming threats when she disclosed her pregnancy. Dawid Gierasimczuk, 40, appeared in Aberdeen Sheriff Court, where he admitted to making terrifying and racist threats towards the woman following her revelation of a positive pregnancy test.

Details of the abusive behavior

Instead of expressing joy at the news, Gierasimczuk reacted violently, telling his ex-partner that he would “do hell for her” upon returning home and that he would “go back to jail” if necessary. His threats escalated to physical violence, as he reportedly throttled the woman and made racist remarks, including threats to “cut off” her head and “cut her eyes out.”

The woman, fearing for her life, contacted the police.

Fiscal depute Rebecca Thompson detailed the events that transpired on May 2, 2023, when Gierasimczuk and the woman were involved in an argument at their shared residence on Barvas Walk. During this confrontation, he placed his hands around her throat, applying pressure for about a minute before releasing her.

Escalation of threats and police involvement

Following the initial incident, Gierasimczuk brandished a lamp at the woman and spat in her face during another argument. On October 23, 2023, after the woman sent him a WhatsApp message with a picture of her positive pregnancy test, he bombarded her with messages demanding she terminate the pregnancy. His messages included alarming statements such as, “When I get back home, I will do hell for you” and “for that, you will pay for everything.”

On the following evening, while in their bedroom, another argument erupted. Gierasimczuk stood over the woman, shouting racist remarks and making threats to “cut off her head” and “cut her eyes out.” The woman recorded parts of this confrontation on her mobile phone, capturing Gierasimczuk’s violent threats. Terrified, she reported the incidents to the police, providing them with screenshots of messages and audio recordings.

Legal repercussions and future steps

In court, Gierasimczuk pleaded guilty to a course of conduct that was abusive towards his former partner. His defense solicitor, Christopher Maitland, indicated that Gierasimczuk had hoped for reconciliation but has now accepted the relationship is over. He acknowledged his need for help to address his mental health issues and his interactions with women.

Gierasimczuk, who had been struggling with alcohol and drug use, recognized the impact of his actions on the victim. Instead of a prison sentence, Sheriff David Hall imposed a community payback order with supervision, requiring Gierasimczuk to complete 210 hours of unpaid work. He is also mandated to participate in a domestic abuse program and is subject to a non-harassment order, prohibiting him from approaching his former partner for three years.
